Four months in prison for having transmitted false information

William Fernandez was sentenced last June 20 to a term of imprisonment of four months and must pay fines totalling 53 574,80 $ to have breached the securities Act.

The decision of the justice of the peace magistrate Nancy Lecompte, of the Court of Québec, district of Salaberry-de-Valleyfield, puts an end to a criminal prosecution brought by thefinancial markets Authority.

Five counts of the indictment

Mr. Fernandez has pleaded guilty to the five counts with which he was faced, or to have provided false or misleading information to three investors (three counts), for the illegal exercise of activity of securities dealer (a chief) and to have the assistance of the placement without a prospectus (a chief).

His company, 9130-3040 Quebec inc., was referred by a count of placement without a prospectus. He was imposed a fine of 12 787,40 $.

In may 2017, the discipline committee of the Chambre de la sécurité financière cancelled permanently Mr. Fernandez. He was exercising his activities as a representative of mfd. Mr. Fernandez had pleaded guilty to the one head of offence content to the disciplinary complaint, or that they lacked integrity in getting his client the sum of approximately 62 849 $ and by failing to remit to him the said sum.
